Equal Education (EE) has been granted permission by the City of Cape Town (the City), to march in Khayelitsha on Human Rights Day, after being threatened by an urgent High Court application. The march is part of EE’s campaign for minimum norms and standards for school infrastructure.
On Monday, 19 March 2012, the City informed EE that its application to hold the march had been denied because the SAPS claimed that they were unable to provide police personnel at the event. EE was set to appear in the Cape Town High Court this afternoon to make an urgent application on the matter but the City granted the permission following an emergency meeting between the City, the SAPS and EE. The march will now proceed as planned with the assistance of the SAPS.
While EE is relieved that the matter was resolved outside of court, it is unfortunate that the City and the SAPS acted in the manner they did. Their poor planning and coordination resulted in EE having to resort to the threat of legal action to ensure its constitutional right to march – as contained in S17 of the Constitution. It also resulted in EE incurring costs, as well as having direct staff and resources away from the planning of the march.
Members of the press are invited to arrive at 09h00 at the Qandani Peace Park, Qandani Street, near Luhlaza High School in Khayelitsha. A press tent will be set up at the start of the march.
